Cusco Travel Agency — General Terms & Conditions


1. Acceptance of Terms

By booking, purchasing, or using any service offered by this agency, the client acknowledges having read, understood, and agreed to all the terms and conditions set forth herein. These terms constitute a binding agreement between the client and the agency. The agency reserves the right to update these terms at any time without prior notice.


2. Reservations & Booking Process

Reservations are confirmed only upon receipt of a deposit payment. A minimum deposit of 50% of the total tour cost is required to secure a booking. The remaining balance must be paid in cash (USD or PEN) upon arrival in Cusco, on or before the first day of service, unless otherwise agreed in writing with the sales agent.

Reservations are strictly personal, non-transferable, and non-endorsable. Booking confirmation will be sent by email once the deposit has been received and verified.


3. Payment Methods

The agency accepts the following payment methods:

  • Bank transfer (details provided by the sales agent)
  • PayPal (subject to a 5.5% transaction fee charged by the platform)
  • Credit/debit card: Visa, Mastercard, American Express, Diners Club

In cases of card payment, the agency reserves the right to request a copy or photograph of the card used, displaying only the first four and last four digits along with the cardholder’s name, as well as a copy of the cardholder’s passport or national ID, to prevent fraudulent transactions.

If the cardholder will not be part of the traveling group, a signed authorization letter must be submitted by email confirming consent for the charge.


4. Pricing & Tax (IGV)

All prices listed are in US Dollars (USD) unless otherwise stated. Foreign tourists not domiciled in Peru are generally exempt from the 18% Value Added Tax (IGV), provided they have been in the country for fewer than 60 days according to their immigration entry stamp (TAM card).

Clients who have been in Peru for more than 60 days at the time of service will be required to pay the 18% IGV surcharge on the total tour value. A copy of the immigration entry stamp may be requested to verify eligibility for the tax exemption.


5. Required Documentation

All clients must carry valid travel documents throughout the duration of all tours and excursions. The following apply:

  • Foreign nationals must carry a valid passport with an active entry stamp (TAM card) issued by Peruvian Immigration.
  • Minors (under 18) must carry their passport or national ID. If traveling with only one parent or a legal guardian, a notarized authorization letter from the absent parent(s) is required.
  • The agency may request and retain a copy of personal documents (passport, national ID, etc.) solely for accounting and administrative purposes. All data will be handled confidentially in accordance with Peruvian data protection law.

Failure to present required documentation at the time of service will result in the denial of service with no refund.


6. Cancellation Policy

Cancellation requests must be submitted in writing (by email) to the agency. The following penalties apply:

Non-refundable items regardless of cancellation timing:

  • Machu Picchu entrance tickets (Ciudadela, Huayna Picchu, Machu Picchu Mountain) — governed by the Peruvian Ministry of Culture
  • Train tickets (PeruRail / Inca Rail) — subject to an additional cancellation penalty of approximately 15% of the original ticket value, as set by the train operators
  • Hotel reservations — subject to each hotel’s individual cancellation policy

7. Modifications & Itinerary Changes

The agency reserves the right to modify the order of excursions or activities without prior notice when circumstances require it, including but not limited to: weather conditions, river levels, road conditions, flight/train/bus schedules, or any other relevant operational reason. Such modifications are made exclusively to ensure client safety and the best possible travel experience.

If an activity within the itinerary is altered, rescheduled at the last minute, or cancelled due to flight delays, social unrest, adverse weather, road blockages, or any inconvenience caused by third parties, the agency is not obligated to issue a refund for the unperformed service.


8. Force Majeure & Unforeseeable Events

The agency shall not be held liable for the non-performance of any contracted service arising from causes beyond its reasonable control, including but not limited to:

  • Adverse weather conditions or natural disasters
  • Political conflicts, civil unrest, strikes, or protests
  • Declaration of states of emergency
  • Border or road closures
  • Acts of God or any unforeseeable event

In such cases, no refund will be issued for the affected services. The agency strongly recommends that all clients obtain comprehensive travel insurance prior to departure to cover these eventualities.


9. Transportation & Transfers

If transportation is included in the purchased package, clients must check in at the bus terminal or airport at the time indicated by the agency, in order to collect their boarding pass and complete the check-in process. The agency is not responsible for services missed due to the client’s delay, late arrival to the boarding point, or failure to complete check-in.

If the client requires pick-up from a location other than the one specified in the itinerary, this must be coordinated in advance with the agency, as additional charges may apply.


10. Altitude Sickness (Soroche)

Cusco is located at approximately 3,400 meters (11,150 ft) above sea level, and several excursions reach considerably higher altitudes. The agency strongly advises clients to:

  • Arrive in Cusco at least one to two days before the start of any strenuous activity to allow for proper acclimatization
  • Stay well hydrated and avoid heavy meals and alcohol upon arrival
  • Consult a physician before travel if they have any pre-existing cardiovascular or respiratory conditions
  • Carry altitude sickness medication if recommended by their doctor

The agency is not responsible for health complications related to altitude sickness. Participation in high-altitude tours is at the client’s own risk.


11. Liability Limitations

The agency acts as an intermediary and/or direct operator of tourist services. The agency’s liability for the non-provision of services due to its own negligence or that of its staff is limited to the actual cost of the specific unperformed service. The agency shall not be held liable for:

  • Personal injury, illness, accident, or death
  • Loss of or damage to personal belongings
  • Acts or omissions of third-party service providers (hotels, transport companies, train operators, etc.)
  • Circumstances beyond the agency’s control as described in Section 8

12. Travel Insurance

Travel insurance is not included in tour packages unless explicitly stated. The agency strongly recommends that all clients purchase comprehensive travel insurance prior to departure, covering medical emergencies, trip cancellation, lost luggage, and evacuation, particularly given the high-altitude nature of activities in the Cusco region.


13. Client Conduct & Responsibilities

Clients are expected to behave respectfully toward guides, staff, other travelers, and local communities at all times. Clients who exhibit disruptive, dangerous, or disrespectful behavior may be removed from the tour without refund.

Clients are responsible for arriving on time to all pick-up points and departure times as specified in the itinerary. Delays caused by the client will not entitle them to compensation.


14. Group Tours

Group tours are subject to a minimum number of participants (typically 4 people) for the departure to be guaranteed. If the minimum is not met, the agency will notify the client as soon as possible and offer an alternative date, a private tour option (subject to additional charges), or a full refund of the deposit.


15. Complaints & Dispute Resolution

Any complaint regarding the services provided must be submitted in writing to the agency by email as soon as possible, preferably within 48 hours of the incident. The agency is committed to responding and resolving disputes in good faith.

These Terms and Conditions are governed by the laws of the Republic of Peru. In the event of a dispute that cannot be resolved amicably, the parties may submit their claim to the competent authorities, including the National Authority for Personal Data Protection (ANPDP) or the relevant consumer protection bodies (INDECOPI).


16. Data Protection & Privacy

The agency collects and processes personal data (name, passport number, nationality, contact information, etc.) solely for the purpose of providing the contracted services, and for administrative, accounting, and legal compliance purposes. All personal information is handled confidentially and in accordance with Peru’s Personal Data Protection Law (Law No. 29733). Client data will not be shared with third parties beyond what is strictly necessary to fulfill the booked services.


17. Intellectual Property

All content on the agency’s website, including text, images, logos, and design, is the exclusive property of the agency. Reproduction, redistribution, or commercial use of any content without prior written consent is strictly prohibited.
